PRAYER: Civil Miscellaneous Appeal is filed under Section 55 of the

Divorce Act, to set aside the decree and judgment passed in I.D.O.P.No.

329 of 2011, dated 17.11.2014 on the file of Principal District Judge,

Kanyakumari at Nagercoil.

JUDGMENT

The appellant had filed I.D.O.P.No.329 of 2011 before Principal

District Court, Kanyakumari at Nagercoil for the relief of divorce. The

said petition was dismissed by the trial Court. Challenging the same, the

present appeal has been filed.

2. Pending appeal, the parties have entered into a settlement out of

Court. The appellant/husband has agreed to pay a sum of Rs.23,00,000/-

(Rupees Twenty Three Lakh only) to the respondent/wife towards future

maintenance. The said amount has also been paid in two installments. On

receipt of the said maintenance amount, the wife has agreed to grant

divorce in favour of the husband by allowing the appeal.

3. The parties have filed a Joint Compromise Memo, dated

19.06.2023. Both the parties and their respective counsels have signed in

the said memo. Both the parties were present and this Court has enquired

them about the contents of the compromise memo and they have agreed

that they have settled the matter and a decree for divorce may be granted.

4. In view of the above said facts, the marriage between the

appellant and the respondent held on 03.05.2006 is dissolved. The

respondent/wife had received a sum of Rs.23,00,000/- (Rupees Twenty

Three Lakh only) towards full maintenance amount and she has no

further claim as against the husband. The compromise memo shall form

part of the decree.

5. With the above said observations, this Civil Miscellaneous

Appeal stands allowed. No costs.
