Judge Court at Erode dated 17.11.2005 in A.S.No.142 of 2002, confirming

the judgment and decree of the District Munsif Cum Judicial Magistrate,

Court at Kodumudi, dated 16.08.2001 in O.S.No.367 of 1996.

JUDGMENT

The learned counsel appearing for the appellants submitted that

many respondents have died and she has also not received any instructions

from the parties. Further, the learned counsel submitted that the Second

Appeal may be dismissed as abated.

2. In view of the submissions made by the learned counsel for the

appellants, the Second Appeal stands dismissed as abated with liberty to

reopen the same when need arises. No costs. Consequently, connected

miscellaneous petitions are also closed.
