JUDGMENT

The unsuccessful plaintiff is the appellant herein.

2. For the sake of convenience, the parties are referred to as per their ranking before the trial Court.

3. The above second appeal is arising out of the suit in O.S.No.610 of

2001. Pending the above second appeal, another suit was also filed by the plaintiff herein in O.S.No.946 of 2004, against which, Second Appeal (MD) No.565 of 2013 is filed and the same is also pending and hence, in view of the fact that the suit properties are one and the same, however, there are many more defendants in that suit, Judgment in both second appeals are pronounced separately, however, on the very same day.

4. The plaintiff has filed the suit in O.S.No.610 of 2001 before the I Additional District Munsif Court, Tiruchirapalli, seeking declaration of his right of access to the lands in various survey numbers that belongs to the defendants 1 and 2 herein for agricultural purpose by taking cattle, tractor or power tiller with trunk and other agricultural aspects during the Tamil Month of 'Maasi' to 'Purattasi' and for consequential injunction.
