Respondent Prayer in : Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for records of the respondent pertaining to the order in Original No.39839 of 2015 dated 29.06.2015 and quash the same and forbear the respondent from proceeding with any recovery of the Adjudicated dues pursuant to the said order in Original as it is partisan, one sided and issued with a closed mind besides being passed in clear violation of the Principles of Natural Justice and in gross judicial indiscipline, as the petitioner had relied upon Judgments of this Court in W.P.No.1641 of 2008 dated 10.01.2011 and W.P.No.3720 of 2009 dated 01.12.2014; besides the orders of Commissioner of Customs (Appeals) pertaining to the valuation of Import of Appeals in the preceding yeas; and also for the reason that the imports in question, impugned in the order under challenge in the present writ petition were on the basis of an “ Apostilled Contract”, issued in terms of “ the Hague Convention, 1961”, to which India as a Sovereign Country is a signatory and the said contract is binding on all Indian Authorities functioning under the aegis of the Indian constitution of India.

In all the writ petitions in Table-I, the respective petitioners have challenged the impugned Order-in-Originals passed by the respective jurisdictional officers of the Customs under various provisions of the Customs Act ,1962. It is submitted that these impugned orders are without jurisdiction as they have emanated from show cause notices issued by the officers from the Directorate of Revenue Intelligence (DRI). In all the writ petitions in Table-II, the petitioners have challenged the impugned Show Cause Notices issued by the officers from the Directorate of Revenue Intelligence.
