PRAYER : Revision Petition filed under Article 227 of the Constitution

of India, to direct the learned Judicial Magistrate, Manamadurai to

expedite the trial in M.P.No.5117 of 2011 new number assigned in

DVC.No.18 of 2022 on its file, within a time frame as may be fixed by

this Court.

ORDER

The present revision petition has been filed by the complainant

in D.V.C.No.18 of 2022 pending on the file of the learned Judicial

Magistrate, Manamadurai, for expeditious disposal of the same.

2. According to the revision petitioner, originally a complaint

was lodged before the Social Welfare Officer in the year 2011, which

was referred to learned Judicial Magistrate, Manamadurai. Interim

protection order was passed for shared residential possession in M.P.No.

5117 of 2011 on 09.08.2011. Thereafter, the main domestic violence

case has not been taken up due to pandemic for a period of two years and

thereafter, on many occasions, the respondents have not appeared.

Hence, she has prayed for speedy disposal of DVC.

3. A perusal of B-Diary extract would indicate that the

petitioner was also absent on many occasions. However, considering the

fact that DVC was taken on file in the year 2011, there shall be a

direction to the learned Judicial Magistrate, Manamadurai, to dispose of

DVC.No.18 of 2022 on or before 30.11.2023. The parties are directed to

co-operate for speedy disposal.

4. With the above observation, the Civil Revision Petition

stands allowed. No costs.
