MADRAS HIGH COURT
Honourable Mr Justice G.ILANGOVAN
Hathija Beevi – Appellant
Versus
The Inspector – Respondent
CRL RC(MD)/993/2022
The court has the discretion to return the property to the petitioner, even if there are other legal heirs, if the legal heirs have given their consent.
Headnote:
CRIMINAL PROCEDURE CODE - SECTION 451, 457 - INTERIM CUSTODY - RETURN OF PROPERTY - CONSENT OF LEGAL HEIRS - COURT'S DISCRETION
Fact of the Case:
The petitioner, as the defacto complainant and owner of the property, filed a petition under Sections 451 and 457 of the Cr.P.C. before the trial Court, seeking interim custody of the jewels involved in the crime. The trial Court dismissed the petition on the ground that apart from the petitioner, other legal heirs were available to the petitioner's father. However, the petitioner produced an affidavit from the brothers of the petitioner, giving their consent for the return of the articles.
Finding of the Court:
The court allowed the criminal revision case and set aside the order passed by the trial Court. The court directed the trial Court to return the articles to the petitioner, after taking photographs of the articles and following the proper procedure.
Issues: Whether the trial Court erred in dismissing the petition for interim custody of the jewels without considering the consent of the legal heirs.
Ratio Decidendi: The court held that considering the affidavit filed by the other legal heirs giving their consent, there can be no objection by the respondent police with regard to the return of the articles as interim custody.
Final Decision: The court allowed the criminal revision case and set aside the order passed by the trial Court. The court directed the trial Court to return the articles to the petitioner, after taking photographs of the articles and following the proper procedure.
