JUDGMENT
The present Civil Miscellaneous Second Appeal is filed by the husband against the Fair and Decreetal order dated 27.02.2012 passed in C.M.A.No.1 of 2011 on the file of the Learned District Judge, Karur, by reversing the Fair and Decreetal order dated 25.08.2010 passed in H.M.O.P.No.120 of 2007 on the file of the Learned Subordinate Judge, Karur.
2. The husband had filed H.M.O.P.No.120 of 2007 under section 13(1) (ia) and (ib) of Hindu Marriage Act , 1995 for dissolution of marriage dated 21.06.2002 on the grounds of cruelty and desertion and the same was allowed. Aggrieved over the wife had filed an appeal in C.M.A.No.1 of 2011 and the same was allowed and the divorce granted by the Trial Court was set aside. Aggrieved by the same the husband had filed the present Civil Miscellaneous Second Appeal.
3. The brief facts stated by the husband is that the marriage between petitioner and respondent had taken place at Sri Balasubramanianwany Temple, Vennaiamaldi, Karur, as per Hindu rites and customs followed by a reception at G.R.Thirumana Mandapam. At the time of marriage, the respondent was presented with 30 sovereigns of gold jewels, cash of Rs.30,000/- and shared as sum of Rs.
