MADRAS HIGH COURT
M.Abitha Banu – Appellant
Versus
State – Respondent
WP/404/2023

Unauthorized construction cannot be regularized and the authorities are entitled to lock and seal such construction.

Headnote:

UNAUTHORIZED CONSTRUCTION - REMOVAL OF LOCK AND SEAL - REJECTION OF REPRESENTATION - [The petitioner's unauthorized construction was locked and sealed by the authorities. The petitioner's representation to the government for removal of the lock and seal was rejected. The court held that the petitioner was not entitled to removal of the lock and seal permanently and dismissed the writ petition.]

Fact of the Case:

The petitioner's husband constructed an unauthorized residential building in 2003. The authorities issued a De-occupation notice in 2018, which was challenged by the petitioner before the 2nd respondent and the High Court. The petitioner's appeals and writ petitions were dismissed. The petitioner then filed a representation to the government for removal of the lock and seal, which was rejected by the 2nd respondent.

Finding of the Court:

The court held that the petitioner's unauthorized construction was locked and sealed by the authorities. The petitioner's representation to the government for removal of the lock and seal was rejected. The court held that the petitioner was not entitled to removal of the lock and seal permanently and dismissed the writ petition.

Issues: Whether the petitioner was entitled to removal of the lock and seal permanently in respect of the unauthorized construction.

Ratio Decidendi: The court held that the petitioner was not entitled to removal of the lock and seal permanently in respect of the unauthorized construction. The court noted that the petitioner's appeals and writ petitions challenging the De-occupation notice and the locking and sealing of the premises had been dismissed. The court also noted that the petitioner had not approached the authorities for removal of the lock and seal for a limited period of time, as directed by the Hon'ble Apex Court.

Final Decision: The court dismissed the writ petition as devoid of merits.
