The writ petition is filed challenging the order passed by the 2nd respondent directing the petitioner to pay a sum of Rs.3,95,000/- towards the housing loan availed by him.
2. The impugned order was challenged by the petitioner mainly on the ground that the amount demanded by the 2nd respondent by impugned notice includes penal interest as well as default interest.

The learned counsel for the petitioner submitted that the petitioner is ready to pay the entire outstanding amount as one time settlement provided the 2nd respondent is ready to waive the penal interest and default interest as per the Government Order in G.O.Ms.No.40, Housing and Urban Development (Vi.Ku.Sa.1) Department, dated 16.03.2015 as extended by G.O.Ms.No.31, Housing and Urban Development (Vi.Ku.Sa.1) Department, dated 03.03.2023. The learned counsel by taking this Court to the above said Government Orders, submitted that when the petitioner is ready to pay the entire outstanding amount by way of One Time Settlement, the petitioner is entitled to waiver of penal and default interest.
4. Mr.R.U.Dinesh Rajkumar, learned Additional Government Pleader takes notice for the 1st respondent and Mr.S.Yashwanth, learned Additional Government Pleader takes notice for the 2nd respondent.

The learned Additional Government Pleader appearing for the 2nd respondent, on instructions, submitted that the above said Government Orders are applicable only to the loans advanced by the Primary Societies out of the funds provided by the Federation. In cases, where the loan is advanced by the Primary Societies out of their own funds, the benefit of the above said Government Orders will not be available.
6. In the case on hand, the loan was paid to the petitioner out of the own funds of the 2nd respondent/Society. When the loan is not advanced to the petitioner out of the funds of the Federation, the petitioner cannot take benefit under the above said Government Orders.
