This Criminal Revision has been filed to call for the records relating to the judgment, dated 23.09.2020 made in Crl.MP No.557 of 2020 on the file of the Judicial Magistrate, Melur, and set aside the same and to direct the learned Judicial Magistrate, Melur to grant interim custody of RC Book of the petitioner's vehicle bearing No.TN-59-AU-3306.
2.The petitioner is the owner of the Tipper Lorry TN-59-
AU-3306. The above said vehicle was seized on the allegation that it was used for illegal transport of soil and it is in the custody of the second respondent Tahsildar, Madurai East. The alleged vehicle along with RC Book was later handed over to the Court. Subsequently, as per the order of this Court made in W.A(MD)No. 948 of 2019, dated 19.09.2019 the petitioner's vehicle was directed to be released by the concerned Magistrate Court on imposing certain conditions. Thereafter, based on the order passed by this Court, the vehicle was returned, however, the RC Book was retained by the learned Judicial Magistrate, Melur.
