ORDER

The grounds raised in the review petition are relating to merits of the case. The suit was instituted for permanent injunction. Interlocutory application was filed under Order VII Rule 11 of the Code of Civil Procedure for rejection of plaint. The Trial Court rejected the petition. The civil revision petition filed by the review petitioners was also rejected.

2. Raising grounds on merits in a review proceedings are untenable.

The scope of review petition is to be confined only with reference to the error apparent if any brought to the notice of this Court.

3. Therefore, the learned counsel for the petitioners raised grounds on merits which is not entertainable for the purpose of reviewing the order already passed by this Court. However, the Trial Court is requested to expedite the trial and dispose of as expeditiously as possible.

4. Accordingly, the Review Application stands dismissed. No costs.
