ORDER

The Criminal Original Petition has been filed, invoking Section

528 B.N.S.S., seeking orders to direct the respondent to expedite the investigation in Crime No.357 of 2024 (Zero FIR) and file final report within the suitable time with due conditions.

2. It is evident from the records that on the basis of the complaint given by the petitioner, Zero FIR came to be registered in Crime No.357 of 2024 on the file of the third respondent and that subsequently, they have recovered the laptop.

3. The learned counsel appearing for the petitioner would submit that though Zero FIR was registered on 09.08.2024, they have not forward the same to the jurisdictional police.

4. The learned Additional Public Prosecutor would fairly concede that though zero FIR came to be registered on 09.08.2024, the same is yet to be sent to the jurisdictional police.

5. The very purpose of registering the Zero FIR is that the victim/

defacto complainant should not put to hardship and at the instance of the victim, FIR has to be registered immediately and then the same has to be forwarded to the jurisdictional police without delay. But in the present case, though Zero FIR was registered on 09.08.2024, even after the lapse of two months, they have not forwarded the same to the concerned police. Hence, the third respondent is directed to forward the Zero FIR in Crime No.357 of 2024 along with the property to the second respondent within a period of three days from today.

6. With the above direction, this Criminal Original Petition stands disposed of. 25.10.2024 NCC : Yes / No Index : Yes / No Internet : Yes / No csm Note : Issue order copy today (25.10.2024)
