Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents to measure and define the boundaries of the petitioners respective sites situated at Survey No.727, Pachapallayam Village, Kangayam Taluk, Tirupur District and mutate the revenue records as per their pattas.

ORDER

The petitioners herein seek a direction to the 3rd Respondent to measure and define the boundaries of the petitioners' property in Survey No.727 situated in Pachapallayam Village, Kangayam Taluk, Tirupur District.

2. It is the case of the petitioners that they were issued with patta in respect of portion of property in Survey No.727 on 22.02.2021. Subsequently, the petitioners submitted a representation before the 1st Respondent on 21.08.2024 seeking survey of the property covered by patta issued to them and fixation of boundaries and the same has not been considered. Hence, the petitioners have come before this Court by way of this writ petition.

3. The learned Additional Government Pleader who takes notice for the Respondents would submit that the representation of the petitioners will be considered by the 3rd Respondent on its own merits within the time fixed by this Court.

4. In view of the same without going into the merits of the claim made by the petitioners, the 1st Respondent is directed to forward the representation of the petitioners dated 21.08.2024 to the 3rd Respondent within a period of 4 weeks from the date of receipt of a copy of this order. The 3rd Respondent shall consider the same and pass final orders on its own merits after issuing notice to the petitioners and other interested parties within a period of 8 weeks from the date of receipt of the representation from the 1st Respondent.

5. Accordingly, the writ petition is disposed of. No costs.
