The use of titles in bodybuilding does not violate the Emblems and Names Act as it is not a commercial exploitation of national symbols.

Headnote:The petitioner seeks a writ of mandamus forbidding the respondents from conducting sporting events under specific titles, claiming violation of Section 3 of the Emblems and Names (Prevention of Improper Use) Act, 1950. The court finds that the use of 'Mr. India' in bodybuilding contests does not constitute improper use as it relates to the sport and does not imply an official designation. The court dismisses the petition for lack of merit.
