Advocates:
Mr.N.Manimaran, Mr.M.Jegadeesh Pandian, Mr.R.Meenakshi Sundaram Additional Public Prosecutor

The court upheld the conviction for trafficking ganja, confirming procedural compliance under the NDPS Act while reducing the default sentence due to the appellants' inability to pay the fine.

Headnote:(A) Narcotic Drugs and Psychotropic Substances Act, 1985 - Sections 8(c) r/w 20(b)(ii)

(B), 25, and 29(1) - Conviction for possession and trafficking of ganja - Appellants convicted and sentenced to 10 years R.I. and fined Rs.1,00,000/- each - Prosecution established possession of 35 kg of ganja through credible evidence and compliance with procedural requirements under Section 42 - Delay in sending samples to lab deemed immaterial as seal was intact - Court confirmed conviction but reduced default sentence from 12 months to 1 month. (Paras 3, 4, 10, 11, 14, 16)

(B) Compliance with Section 42 - The court emphasized that while total non-compliance is impermissible, delayed compliance with satisfactory explanation is acceptable. (Paras 10.1, 10.6)

(C) Evidence and Recovery - The presence of crime number on recovery documents does not inherently create doubt about the recovery if the overall evidence is credible. (Paras 12.1, 12.6)

Facts of the case:
The appellants were found in possession of 35 kg of ganja during a police operation on 01.11.2021. They were arrested after attempting to flee when police intercepted their vehicle. The trial court convicted them based on the evidence presented.

Findings of Court:
The prosecution proved its case beyond reasonable doubt, and the conviction was upheld with a modification to the default sentence.

Issues: Whether the prosecution established the case beyond reasonable doubt and if the trial court's conviction was sustainable.

Ratio Decidendi: The court ruled that procedural compliance under Section 42 was met, and the evidence presented was credible, affirming the conviction while reducing the default sentence due to the appellants' inability to pay the fine.

Result: Appeals partly allowed.
