Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the first respondent to pass appropriate order protecting the petitioner and his family members from excommunication and to enable the petitioner's family to cultivate the lands in S.F.Nos.17/1, 17/24, 14/4, 14/5, 13/3, 13/10, 64/11, 64/1, 64/6, 1/1, 2, 3/1 of Enangam Village, Avudaiyarkoil Taluk, Pudukkottai District by giving necessary police protection to the life of the petitioner and his family considering the petitioner's representation dated 29.10.2014 within stipulated time fixed by this Court.

O R D E R

The present Writ Petition has been filed seeking a Writ of Mandamus directing the first respondent to pass appropriate orders to protect the petitioner and his family members from excommunication and also to give necessary police protection for cultivation of the alleged lands in certain Survey Numbers.

2. The learned Counsel appearing for the petitioner submits that the petitioner had passed away and the issue relating to excommunication has been resolved.

3. The learned Special Government Pleader appearing for the fourth respondent herein has submitted a report from the Sub Inspector of Police, Yembal Police Station, Pudukkottai District to the effect that as on today, there is no issue relating to excommunication and the people in the said Village live in harmony.

4. As far as the other prayer relating to police protection for enjoyment of the property is concerned, it is for the legal heirs of the writ petitioner to approach the competent civil Court.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
