L.Victoria Gowri, J
Sankar Ganesh – Appellant
Versus
State of Tamil Nadu – Respondent
CRL RC(MD)No.634 of 2025

Advocates:
For the Appellants/Petitioners: Mr.P.Arun Jayatram
For the Respondents: Mr.S.Ravi, Additional Public Prosecutor

Custodial requirements necessitate return of seized vehicles to prevent depreciation, conditional on compliance with legal stipulations.

Headnote:The petitioner filed for the return of a vehicle seized during a criminal investigation under various statutes. The court noted that the vehicle was not involved in previous offenses and that its custody was causing depreciation in value. Thus, it permitted the vehicle's return with conditions. The pivotal question regarded the condition of the vehicle and the legal justification for its return. The court concluded that the return of the vehicle, subject to specific conditions, was warranted due to its potential deterioration while held in custody.
