COMMON JUDGMENT

The plaintiffs in C.S.No.616 of 2011 prays for a preliminary decree of declaration that they are entitled to 3/22 share over the Schedule – A property and 3/11 share over the Schedule – B and C Property.

2. The defendants 9 to 12 the said suit instituted C.S.No.700 of 2011 seeking to (i) partition of schedule mentioned property ; (ii) recovery of a sum of Rs.1,32,618/- from defendants 1 to 4, towards the plaintiff's share towards rent in respect of the suit premises for the months of May, June and July, 2011 and also to pay the plaintiffs their 50% share in the rental income in respect of the suit premises from August 2011 onwards ; (iii) direct the defendants 1 to 4 to render proper accounts of the income derived from the family book binding business under the name and style of M/s.S.M.Binding Works at the rear portion of the Ground Floor in the suit property of an extent of 3600 sq.ft. for the period of 3 years prior to the filing of the suit and pay the plaintiffs each
