O R D E R
This Writ Petition has been filed seeking a direction to the first respondent to issue a non traceable certificate in respect of the share certificate bearing No. 159633 standing in the name of Late.Sivasubramanian on the basis of the petitioner online complaint dated 22.2.2025.
2.For the sake of convenience, the power agent is termed as petitioner.
3.According to the petitioner, he is the power of attorney of one Maragatham and Kanaga Thurka. The said Kanaga Thurka is the daughter of the said Maragatham. One Sivasubramanian is the husband of Maragatham and father of Kanaga Thurka and he purchased the share certificates. While so, the said Sivasubramanian died on 19.11.2012 intestate leaving behind Maragatham and Kanaga Thurka as legal heirs. Thereafter, Maragatham and Kanaga Thurka filed a petition before the Principal Sub Court, Madurai in S.O.P.No.4 of 2018 for succession certificate and the same was allowed on 16.11.2023.
