Nallavanpalayam Village Thiruvannamalai Taluk Thiruvannamalai District Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the respondents 1 to 5 especially the fifth respondent, to act on the petitioner's representation dated 06.12.2024 by implementing the order dated 25.05.2023 passed by this Court in W.P.No.16227 of 2023 in pursuance of the order dated 02.08.2023 passed by the first respondent under his proceedings dated 02.08.2023 vide Na.Ka.No.A2/1028567/2023 and thereby, forthwith removal of encroachments / illegal structures as constructed in the form of kitchen/cooking room in the water body (odai poramboke) which is comprised in S.F. No.67/2 of Samuthiram, Nallavanpalayam Village, Thiruvannamalai Taluk, Thiruvannamalai District, put up by respondents 6 and 7 and to file an appropriate valid report by the fifth respondent towards the removal of the said encroachments and further, direct him to carry out periodic inspection and survey and to take all effective steps to ensure that the said water canal is free of encroachments of any nature in future.

After some arguments, Mr. L.K. Manjunath, learned counsel on record for writ petitioner, sought leave of this Court to withdraw the captioned 'writ petition' (hereinafter 'WP' for the sake of brevity) but made a plea to preserve all the rights and contentions of the writ petitioner to file a contempt petition, if so advised and so desired qua order dated 25.05.2023 in W.P.No.16227 of 2023. This request is acceded to.

2. Learned counsel has made an endorsement in the case file and a scanned reproduction of the same is as follows:

3. In the light of the narrative thus far, captioned WP stands disposed of as withdrawn/closed, albeit with preservation of rights of the writ petitioner in the aforesaid manner. There shall be no order as to costs.
