Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 1st respondent to make the necessary corrections of date of birth, gender and update the biometrics in the Aadhaar Card No.897458376761 and same issue correct Aadhar card to the petitioner sister's son namely P.Jabaraj and considering the petitioner representation sent to the respondents dated 20.01.2025, 17.02.2025.

ORDER

The prayer in the Writ Petition is to make the necessary corrections in respect of the Aadhar Card No.897458376761 and issue the correct Aadhar Card to one P.Jabaraj, to whom the petitioner is the guardian by considering the petitioner's representation, dated 20.01.2025.

2. The said P.Jabaraj bears the said Aadhar Card. A copy of the same is annexed along with the Writ Petition. It can be seen that the date of birth of the said Jabaraj is wrongly mentioned as 24.07.2009, while the correct date of birth is 24.09.2009. This apart, the gender is also mentioned as female, whereas, Jabaraj is a male person. In view of the erroneous entry, grave prejudice is caused to him. Therefore, the petitioner is praying for correction of the entries.

3. When the matter is taken up for admission, Mr.N.Sivaprakash, the learned Counsel took notice for the first respondent and sought time to get instructions. Thereafter, now, on written instructions, he would submit that if the petitioner produces any one of the valid documents, such as valid passport or birth certificate issued by the authorised authority, the date of birth will be effected. Similarly, the biometrics will be updated and the gender can also be corrected. It is stated that the UIDAI itself has contacted the petitioner and will guide him on the biometric update, date of birth update, gender update etc.

In view thereof, the first respondent authority, through itself or through any subordinate/agency, shall contact the petitioner, S.Murugavel, who is acting on behalf of the said Jabaraj and issue a communication to the address at No.5/286, Manmathan Kovil Street, Melavanagiri, Serkazhi taluk, Mayiladuthurai district. Upon the petitioner being contacted, the petitioner, along with the said Jabaraj, shall visit the biometric updation center, wherever, as directed by the respondent authorities or its agencies and shall also produce the birth certificate and also update the other biometrics so that the Aadhar Card can be corrected. The aforesaid exercise shall be completed within a period of twelve weeks from the date of receipt of a web-copy of this order without waiting for a certified copy of this order.

5. This Writ Petition is disposed of accordingly. There shall be no order as to costs.
