Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorarified Mandamus, calling for the records of the respondents particularly that of the 2nd respondent dated 10.02.2025 and quash the same as illegal, unlawful, ultra vires and consequently forbear the 2nd respondent from in any manner interfere with nor disturb the petitioner from continuing with his life membership No.341 and pass such further or other order.

ORDER

This Writ Petition is filed for a prayer calling for the records on the file of the 2nd respondent dated 10.02.2025 and to quash the same and consequently forbear the 2nd respondent from in any manner interfering with or disturbing the petitioner from continuing his life membership No.341.

2. The impugned order is passed by the 2nd respondent which is a society registered under the Tamil Nadu Registration Act, 1908. Therefore, it is a private organisation and it is also not exercising any public duty exercisable by the State.

3. In view thereof, the Writ Petition against a private person is not maintainable. Keeping open the liberty of the petitioner to approach the appropriate forum, this Writ Petition stands dismissed as not maintainable. 4. In view of the urgency that is expressed, in the open Court itself, the original impugned order is returned to the learned counsel for the petitioner. The learned counsel for the petitioner can make an endorsement in the docket of the Writ Petition that he has received the original impugned order. No costs.

Consequently, the connected miscellaneous petitions are closed.
