The court will appoint an arbitrator under the Arbitration and Conciliation Act, allowing parties to seek interim relief.

Headnote:The Arbitration and Conciliation Act, 1996, allows for the appointment of an arbitrator by the court under Section 9. In this case, both parties consented to appoint Mr. P. Giridharan as the sole Arbitrator for arbitration proceedings stemming from their License Agreement dated 19.08.2014. The court emphasized that the arbitrator will conduct proceedings following due process without prejudice to the merits of the application before him. The court expressly stated, 'Arb. Appln. No.59 of 2025 is disposed of by issuing the following directions.'

ORDER

Both counsels have made a joint endorsement on instructions that the parties are agreeable to go for arbitration through Mr.P.Giridharan, Advocate being appointed as the sole Arbitrator to adjudicate the disputes between the parties arising out of the Licence Agreement, dated

19.08.2014.

2. The learned counsel for the applicant also submits that liberty may be granted to the applicant to seek similar reliefs under Section 17 of the Arbitration and Conciliation Act, 1996 before the Arbitrator as sought for in Arb. Appln. No.59 of 2025.

3. In view of the joint endorsement made by both the counsels on instructions from their respective clients, this Court appoints Mr.P.Giridharan as the sole Arbitrator to adjudicate the disputes between the parties arising out of the License Agreement, dated 19.08.2014. Accordingly, Arb. Appln. No.59 of 2025 is disposed of by issuing the following directions :-

a) This Court appoints Mr.P.Giridharan, Advocate, who is having office at Vanguard House, 3rd Floor, No.48, Second Line Beach, Parrys, Chennai – 600 001 (Mobile No.9884672733) as the sole Arbitrator to adjudicate the dispute between the parties arising out of the License Agreement, dated 19.08.2014.

(b) The Arbitrator shall be paid his remuneration / fees in accordance with the 4th schedule of the Arbitration and Conciliation Act, 1996 .

(c) Both the parties shall equally share the arbitrator's fees.

(d) The Arbitrator shall conduct the arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 and shall complete the arbitration within the specified time as prescribed under the said Act.

4. It is made clear that in view of the appointment of a sole Arbitrator by this Court, Arb. Appln. No.59 of 2025 filed under Section 9 of the Arbitration and Conciliation Act, 1996 is disposed of, without expressing any opinion on the merits of the said application. It is for the Arbitrator to decide the merits once an application is filed seeking for interim protection under Section 17 of the . Liberty is granted to both the parties to file an application under of the seeking for an interim protection pending final adjudication of the arbitral dispute. The Arbitrator shall decide those applications as and when they are filed on merits and in accordance with law.
