PETITION FOR RELAXATION Under Sec.528 of BNSS PRAYER :- To relax the condition imposed on the petitioner by order, dated 11.06.2025, passed in Crl.MP.No.1404 of 2025.
ORDER : The Court Made the following order :-
This petition has been filed to relax the condition imposed on the petitioner in Crl.MP.No.1404 of 2025 dated 11.06.2025.
2. The learned counsel for the petitioner would submit that this petitioner has filed a bail application in Crl.MP.No.1404 of 2025 before the learned Principal Sessions Court for NDPS Act Cases, Madurai and the same was ordered with the following conditions:
i. the petitioner shall execute a bond for a sum of Rs.25,000/- along with two sureties are must be blood sureties and also both sureties are must be petitioner's own locality.
ii. The petitioner shall appear and sign before the respondent police station daily at 10.00a.m. for the period of 30 days and thereafter he should appear and sign before the respondent police station at 10.00a.m. once in a month on the 2nd working day of English Calender month until the case is taken on file and the petitioner shall not indulge in any similar offences in future.
3. He further submits that this petitioner has filed a relaxation petition before the learned Principal Special Court for NDPS Act Cases, Madurai in Crl.M.P.No.2069 of 2025 and the same was dismissed on 08.07.2025. However, this petitioner reporting before the respondent police from 14.06.2025 to till date. This petitioner pursuing B.Sc., (catering Science and Hotel Management) in Bell Institute, Sivakasi and he is a day scholar. Since, he is reporting before the respondent police Keeraithurai, Madurai at 10.00a.m and he is not able to attend the college which is situated at Sivakasi. It is just and necessary to relax the said condition imposed on the petitioner. Hence, he prays to allow the present relaxation petition.
4. The learned Government Advocate (Crl.Side) submitted that the petitioner has complied with the condition from 14.06.2025 to till date.

Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to relax the reporting condition alone imposed by the learned Principal Sessions Court for NDPS Act Cases, Madurai in CrlMO.P.No.1404 of 2025 dated 11.06.2025. Accordingly, the condition imposed on the petitioner i.e., ii. The petitioner shall appear and sign before the respondent police station daily at 10.00a.m. for the period of 30 days and thereafter he should appear and sign before the respondent police station at 10.00a.m. once in a month on the 2nd working day of English Calender month until the case is taken on file and the petitioner shall not indulge in any similar offences in future is hereby relaxed and the same is modified as ''The petitioner shall appear before the concerned Trial Court on receipt of summons. ''
6. With the above said modification, this Criminal Original Petition is allowed.
