PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner, who apprehend arrest at the hands of the

respondent police for the alleged offences under sections 406 and 420

of IPC in Crime No.72 of 2021 seeks anticipatory bail.

2. The case of the prosecution is that, due to land business,

the petitioner along with other accused persons cheated the defacto

complainant. Hence the complaint.

3. There is no representation for the petitioner.

4. The learned Government Advocate (Crl.Side) brought to the

notice of this Court that the petitioner along with other accused

K.A.Srinivasan approached this Court seeking anticipatory bail in

Crl.OP.No.1418 of 2022 in which, this Court has granted anticipatory

bail, in the event of arrest, in Crime No.72 of 2021 on certain

conditions.

5. Taking note of the fact that the petitioner herein was not

complied with the condition but come before this Court by filing the

second anticipatory bail petition. However, stating that, as if this

is the first anticipatory bail petition and no similar petition filed

or pending in any other Court.

6. Considering the supression of the fact that the petitioner

was already granted anticipatory bail and the petitioner did not

complied with the said condition, this Court is not inclined to grant

anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed.
