PRAYER:

Appeal against the Judgment and Decree of the Subordinate

Court, Mannaargudi dated 10.08.2011 in A.S.No.57/2010 preferred

agaist the Judgment and Decree of the Court of the District

Munsif, Mannaargudi, dated 22.12.2009 in OS No.171 of 2003.

DECREE:-

This Second Appeal coming on for hearing on this day upon

perusing the Grounds of appeal, the Judgment and decrees of the

Lower Appellate Court and the Court of First Instance and the

material papers in the suit and upon hearing the arguments of

Mr.P.G.Padmanabhan, Advocate for the appellant, and that there

be no respresentation either in person ofr by Advocate for the

respondent and this Court while allowing the second appeal doth

doth order and decree as follows:

1.That the Judgment and Decree of the Subordinate Judge,

Subordinate Court, Mannaargudi dated 10.08.2011 made in

A.S.No.57/2010 be and hereby is set aside;

2.That the Judgment and Decree of the District Munsif,

Mannaargudi dated 22.12.2009 made in OS No.171 of 2003 be and

hereby in restored and accordingly, the suit filed by the

plaintiff be and hereby is dismissed; and
