PETITION FOR BAIL 439 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner, who was arrested on 07.02.2022 for the offences

punishable under Sections 354(A), 376, 511 of IPC, in Crime No.68 of

2022, on the file of the respondent police, seeks bail.

2. The allegation made against the petitioner is that on

07.02.2022 at mid night, the petitioner knocked the door of the

defacto complainant who is a deaf and dumb girl who has no parents

and relatives. When she opened the door, petitioner barged into the

house and attempted to rape her. Since, she was deaf and dumb, she

could not inform this to anyone immediately and later she informed

this incident to her cousin brother viz., Babu who is working in

Bangalore. He told her that he would come after one week and the

complaint was given on 17.02.2022.

The learned counsel for the petitioner submitted that the

petitioner is an innocent and he has been falsely implicated in this

case due to previous enmity. He is judicial custody from 17.02.2022.

The learned Additional Public Prosecutor strongly opposed

this petition on the ground that the petitioner attempted to commit

rape on a deaf and dumb girl.

Heard the submissions made by the learned counsel for the

petitioner and the learned Public Prosecutor for the respondent

Police.

The allegation against the petitioner is very serious in

the sense that he said to have attempted to rape a deaf and dumb

girl, who has no parents and relatives and helpless and hapless.

Petitioner is not able to give details as to the alleged previous

enmity between the defacto complainant and the petitioner.

Considering the seriousness of the allegations made against

the petitioner, this Court is not inclined to grant bail to the

petitioner.

8.

Accordingly, this Criminal Original Petition is dismissed.
