Application No.1302 of 2022 has been filed to condone the delay of 124
days in filing the application to set aside the exparte in A.D.No.109773 of 2021
in T.O.S.No.2 of 2020 before this Court.
2.In T.O.S.No.2 of 2020, the suit summons were served on the
defendants and they engaged a counsel to contest the suit. Due to pandemic
situation, the counsel did not follow up the matter and hence, he brought a
change of Vakalat and handed over the case to the present counsel on record
and he filed a Vakalat along with the Written Statment, the same was returned.
At this juncture, he came to know that he was set exparte on 02.07.2021 and
hence he filed an application to condone the delay of 124 days in filing the
application to set aside the exparte in A.D.No.109773 of 2021 in T.O.S.No.2 of
2020.

3.Heard Mr.K.P.Padmanaban, learned counsel for the applicant and
Mr.P.Rajamanickam, learned counsel for the respondents.
4.Learned counsel for the respondents has no serious objection in
allowing this application.
5.Having satisfied with the reasons stated in the affidavit filed in support
of this application, this application is allowed as prayed for.
6.Registry is directed to list the matter along with other application on
12.04.2022.
