MADRAS HIGH COURT
S.MOHAMMED ASAN – Appellant
Versus
THE INSPECTOR OF POLICE – Respondent
CRL MP/20099/2022

A petitioner may be entitled to suspension of sentence and bail pending the disposal of an appeal if the appeal raises substantial grounds and is not likely to be taken up in the near future.

Headnote:

CRIMINAL LAW - SUSPENSION OF SENTENCE - POSCO ACT - [The court suspended the sentence imposed on the petitioner under Sections 451 and 354(A)(i) of the Indian Penal Code, pending the disposal of his appeal, considering the arguable points raised in the appeal and the unlikelihood of the appeal being taken up in the near future.]

Fact of the Case:

The petitioner was convicted and sentenced to one year imprisonment and a fine of Rs.1000/- under Section 451 of the IPC, and two years imprisonment under Section 354(A)(i) of the IPC, by the Mahila Court/Additional Special Court for exclusive trial of cases under POSCO Act, Coimbatore.

Finding of the Court:

The court found that the petitioner had raised substantial grounds in the appeal which required detailed appraisal, and that the appeal was not likely to be taken up in the near future.

Issues: Whether the petitioner was entitled to suspension of sentence and bail pending the disposal of his appeal.

Ratio Decidendi: The court held that the petitioner was entitled to the relief of suspension of sentence and bail, considering the arguable points raised in the appeal and the unlikelihood of the appeal being taken up in the near future.

Final Decision: The court granted the relief of suspension of sentence on the condition that the petitioner surrender before the Trial Court within two weeks from the date of receipt of a copy of the order and execute a bond for a sum of Rs.10,000/- along with two sureties, each, for a like sum.
