Petition praying that in the circumstances stated therein the

High Court will be pleased to

[I]call for the records relating to the charge sheet(final

report) filed by the 1st Respondent IN C.C.NO.254 of 2017 on the fiel

of the learned Judicial Magistrate Court, Tambaram and quash the

same.[CRL.OP.NO.4800/2018]

[II]Stay of all further proceedings in IN C.C.NO.254 of 2017 on

the fiel of the learned Judicial Magistrate Court, Tambaram pending

disposal of the quash petition.[CRL.MP.NO.2374/2018]

[III]dispense with the personal appearance of the petitioners in

C.C.NO.254 of 2017 on the fiel of the learned Judicial Magistrate

Court, Tambaram pending disposal of the quash petition.

Order : This petition coming on for orders upon perusing the

petition and upon hearing the arguments of M/S.S.KUMARADEVAN

Advocate for the petitioner and of MR.C.RAGHAVAN Government Advocate

[Crl.side]on behalf of the respondent , the court made the following

order:-

In connection with the same set of averments made in an

identical complaint, this Court had entertained a quash petition in

Crl.OP. No.3574 of 2018 and granted interim orders. In view of the

same, it would be appropriate to extend the same relief in the

present petition also.

2. Hence, there shall be an order of interim stay of all further

proceedings in C.C.No. 254 of 2017 pending on the file of the learned

Judicial Magistrate, Tambaram.

3. The personal appearance of the petitioner before the learned

Judicial Magistrate, Tambaram in connection with C.C.No. 254 of 2017

is dispensed with.

4. Mr.C.Raghavan, learned Government Advocate (Crl.Side) takes

notice on behalf of the first respondent. Notice to the second

respondent returnable by 06.03.2018. Private Notice is also

permitted.

Post the matter on 06.03.2018.
