CRL A No. 1461 of 2025

Bail can be granted based on custody duration and considerations of the case's evidentiary landscape.

Headnote:In this appeal under Section 14-A(2) of the SC/ST Act 1989, the appellant seeks bail by challenging the Sessions Court's refusal. The Court assessed the facts surrounding a FIR alleging abandonment post-marriage affecting community relations. The Court found merit in the argument for bail based on the period of custody. It identified the primary issue as whether bail was warranted considering ongoing investigations. The decision kicked off from detailed considerations of statutory provisions and the appellant's situation. The appeal was allowed, and conditions for release were specified.
