IN THE HIGH COURT OF JUDICATURE AT MADRAS
SUNDER MOHAN, J
Muhammed Farook – Appellant
Versus
The State of Tamil Nadu – Respondent
Crl.O.P.(MD).No.15218 of 2025

Advocates:
For the Appellants/Petitioners: Mr.P.Selvakumar
For the Respondents: Mr.R.M.Anbunithi, Mr.M.Mohideen Abdul Kathar Jailany

The court allows the quashing of an FIR under IPC sections 465, 468, 471, and 420 due to a valid compromise between involved parties.

Headnote:This judgment addresses the quashing of an FIR registered under Sections 465, 468, 471, and 420 of the IPC. The petitioners contended that the property dispute between them and the defacto complainant was settled through a compromise. The Court found the compromise satisfactory, indicating that further investigation into the FIR would serve no useful purpose. The primary issue was whether the continuing investigation was warranted amid the agreed resolution between the parties. The Court reasoned that the nature of the offenses and the settlement rendered the FIR non-viable. The court quashed the FIR, allowing the Criminal Original Petition.

3. Admittedly, the dispute between the petitioner and the second respondent is essentially with regard to the property and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 8th September 2025 and the scanned copy of the compromise memo reads as follows:

4. The petitioners, namely, Muhammed Farook (Aadhaar No.5634 4393

They are identified by Mr.A.Mohan, Special Sub Inspector of Police, DCB-II Police Station, Tuticorin District. All the parties confirmed the compromise arrived at between them.

5. In view of the same and considering the nature of the offences and the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.29 of 2025 dated
