O R D E R

This contempt petition is filed alleging non compliance of the order

passed by this Court on 30.11.2017 in W.P.No.31168 of 2017.

2. When the matter was taken up for hearing, the learned Special

Government Pleader appearing for the Respondent submitted that though

the water channel in question is classified as 'Vaikkal', there is no

encroachment. He has also produced the proceedings dated 15.09.2023 of

the Revenue Divisional Officer addressed to the District Collector to that

effect and the same is scanned and annexed hereunder:

3. He further submitted that the water will flow on the 'Oodai' only

during rainy season and on non rainy season it is used as a 'path way'.

4. Recording the submission made by the learned Additional Public

Prosecutor and also the proceedings dated 15.09.2023, this contempt

Petition stands closed. No costs.
