Prayer: Petition is filed under Sections 232 & 276 of the Indian Succession

Act, and Order XXXIX of 1925, for the grant of Letters of Administration.

As per order of this Court, dated 20^th day of August 2009 in Application

No.3268 of 2006, Letters of Administration granted on 16^th day of

December 2003, in O.P.No.549 of 2003 is revoked and the Original Petition

has been converted into Testamentary Original Suit No.9 of 2009.

J U D G M E N T

On 06.01.2023, when the case was listed for hearing, the learned counsel for

the plaintiff informed the Court that he had no instructions from his client

and hence this court directed the Registry to list the case on 09.01.2023 by

printing the name of the plaintiff in the cause list. Today, though the name

of the plaintiff is printed in the cause list, there is no representation for the

plaintiff.

2. In such view of the matter, the Testamentary Original Suit is dismissed

for default. No costs.
