Prayer: Writ Petition under Article 226 of the Constitution of India

praying for a writ of Mandamus directing the respondents 1 to 4 herein

to take necessary action on the petitioner representation dated

10.01.2023 and direct the respondents 1 to 4 herein to remove

obstruction made by the respondents 5 and 7 and there are

encroached the government land and requesting to demolish the

construction.

This writ petition has been filed seeking a direction to the

respondents 1 to 4 to take necessary action on the representation of

the petitioner dated 10.01.2023 for removing the alleged

encroachment made by the respondents 5 to 7.

2. The petitioner is residing in Road Street, Kaladi Village,

Kalasapakkam Taluk, Tiruvannamalai District. According to her, the

respondents 5 to 7 have encroached five feet, out of 15 feet of the

Government road side poramboke land and therefore, she made a

detailed representation to the official respondents on 22.11.2022 and

thereafter, another representation on 10.01.2023. As no action has

been taken on the said representations, the petitioner has come up

with this writ petition.

3. A perusal of the copy of the representations discloses that the

petitioner herself has occupied the poramboke land. Further, the said

representations do not throw any light as to the alleged road side

encroachment made by the respondents 5 to 7 causing nuisance to

the public or waterbody.

4. In view of the above, we do not find any merit nor justification

to entertain this writ petition. Accordingly, this writ petition is

dismissed. However, it is made clear that if there is any encroachment,

the same shall be removed by the official respondents. There will be

no order as to costs.
