ORDER

The petitioner, who is working as a Head Master of the Panchayat Union Middle School has applied for B.Ed., Course in the respondent University through the 3rd respondent the Government College of Education, Pudukottai.

2.The petitioner claims that he has completed B.Ed., course in the year 2013. However, the provisional certificate has not been issued to him and therefore, the petitioner has filed this writ petition, for a writ of mandamus directing the 2nd respondent to issue him mark statement and provisional certificate within a reasonable time.

3.The 2nd respondent has taken a specific stand that this petitioner has not produced the practical records, which are compulsory and therefore, he cannot claim that he has completed the course and he is entitled for provisional certificate. The relevant portion of the counter affidavit of the respondents 1 and 2 is extracted hereunder “5.As per the student hand book and prospectus of IGNOU, BEd., programme of 2011 (ref.16-17) the following requirements for successful completion of the BEd., programme.

Group A- Five Core courses from ES 331 are to be completed:

Group B- Two Course of content based methodology ie., ES 341-345 and BESE 046 are to be completed.

Group C- any one special course out of ES

361-364 to be completed along with BESE 65 and 66 (Jan 2011) onwards BEd., students are supposed to complete also).

Group D- three practical courses are to be completed ie.ES 381, 382 and 383.

6.The petitioner has completed the theory components through term and exam and also attended the first and second year BEd., the petitioner has failed to submit the practical records which are compulsory components for evaluation. The 3rd respondent sent a communication by proceedings in RCNo.273/B/2021 dated 03.06.2021 stating that the petitioner has not submitted the records. The above relevant records show that the petitioner has not fulfilled the guidelines and has not submitted the following records:

a.ES 381 – School based practicals b.ES 382 – Workshop based practicals c.ES 383 – Practice teaching”

4.In view of the specific stand taken by the respondents and in the absence of any material to show that the petitioner has completed the practical examination viz., ES 381 – School based practicals; b.ES 382 – Workshop based practicals; and c.ES 383 – Practice teaching, as required in the students hand book and the prospectus, this court is not inclined to entertain this writ petition. Accordingly this writ petition is dismissed. The petitioner is at liberty to approach the 1st respondent once again for continuing the course with the 1st respondent and the 1st respondent shall consider the request of the petitioner and proceed further. No costs.
