O R D E R
The Civil Revision Petition is filed to set aside the fair and decretal order in IA No.18 of 2022 in AS No.17 of 2022 dated 02.12.2023 passed by the learned Subordinate Judge, Katpadi and to order the said IA as prayed for.
2. The revision petition is the appellant in AS No.17 of of 2022. The revision petitioner/appellant filed an application in IA No.18 of 2019 to implead the second respondent/proposed respondent in the appeal. The first appellate court, by order dated 02.12.2013, dismissed the the said application. Challenging the said dismissal order, the petitioner has filed the present civil revision petition.
3. Learned counsel for the petitioner submits that pending litigation, the proposed respondent has purchased the suit property on 03.12.2019 from the first respondent. Therefore, he has to be impleaded as a necessary party, which is declined by the appellate court. Hence, seeking to allow the revision.
4. Heard the learned counsel for the petitioner and perused the materials available on record.
