ORDER
This criminal original petition has been filed challenging the order passed by the Court below in Crl.M.P.No.412 of 2024, dated 05.02.2024, dismissing the application filed by the petitioner seeking for suspension of sentence pending the appeal in Crl.A.No.8 of 2024. 2.This Court has carefully considered the submissions made by the learned counsel for the petitioner and the materials available on record. 3.The petitioner was convicted for offence u/s.138 of the Negotiable Instruments Act by the learned Additional District Munsif~cum~Judicial Magistrate, Ambur through judgment dated 15.12.2023 and was sentenced to undergo six months simple imprisonment and to pay Rs.4,58,000/~ to the complainant as compensation within one month, in default, to undergo two months simple imprisonment. On the date of judgment, the petitioner did not appear and hence, non~bailable warrant was issued against him. Aggrieved by the same, the petitioner filed an appeal in Crl.A.No.8 of 2024 on the file of Principal Sessions Judge, Vellore.
