Writ petitions under article 226 of the Constitutions of India

praying that in these circumstances stated therein and in the

affidavit filed their with the High Court will be pleased to

(I) Issue a writ of certiorarified mandamus or any other

writ, order or direction in the form of the writ to call for the

records Connected with the proceedings issued in KA.NO

917/2017/Va.A. dated 25.10.2017 passed by the 2nd Respondent and

NA.KA. NO R2/584/2014 dated 28.8.2020 passed by the 1st Respondent

and quash the same and consequently direct the Respondents to

enhance the compensation for the Petitioners land situated in SR.

No 196/2 1.13 cent IN WP No.3644 of 2021 and;

(II) To Dispense with the production of original proceedings

issued in KA.NO 917/2017/Va.A. dated 25.10.2017 passed by the 2nd

Respondent and NA.KA. NO R2/584/2014 dated 28.8.2020 passed by the

1st Respondent IN W.M.P.No.4174 of 2021 Respectively.

Order : This petition coming on for orders upon perusing the

petition and the affidavit filed in support thereof and upon

hearing the arguments of S.ILAMVALUDHI, Advocate for the petitioner

and of Mr.KMD. Muhilan, Government Advocate on behalf of the

Respondents the court made the following order:-

The grievance of the petitioner is with regard to fixation of

compensation for the lands acquired from the possession of the

petitioner, a sum of Rs.16,620/- has been awarded as compensation

to the petitioner, whereas for a similarly placed person and for a

similar extent of land, the Acquisition Officer has fixed

Rs.74,740/- as compensation. In such circumstances, the present

writ petition has been filed seeking enhanced compensation.

2. Mr.KMD. Muhilan, learned Government Advocate appearing for

the respondents is directed to get instructions on what basic the

compensation amount has been fixed.

3. Post for orders on 13.07.2021.
