The authority must follow mandatory procedures under Section 34 of the Hindu Religious and Charitable Endowments Act, 1959, before sanctioning the sale of temple lands.
Headnote:The judgment discusses the Alienation of Immovable Trust Properties rules pertinent to temple lands. The petitioner's claim was founded on Section 34 of the Hindu Religious and Charitable Endowments Act, 1959, asserting the authority's failure to follow mandatory procedures prior to ordering the sale of temple property. The court found the directive given by the 1st respondent as unsustainable and lacking jurisdiction due to non-compliance with necessary legal requirements. The order was thus quashed in favor of the petitioner.
