PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 2nd respondent to forthwith consider the petitioners' representation dated 19.07.2025 and refer Award No.C5/ 021/ 2022 dated 20.07.2023, to the appropriate Court for enhancement of compensation under Section 8(1) of the Tamil Nadu Acquisition of Land for Industrial Purposes act, 1997 within a time frame to be fixed by this Court.

ORDER

This writ petition has been filed by the petitioner seeking to direct the 2nd respondent to forthwith consider the petitioners' representation dated 19.07.2025 and refer Award No.C5/ 021/ 2022 dated 20.07.2023, to the appropriate Court for enhancement of compensation under Section 8(1) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997.

2.Mr.B.Vijay, learned Standing Counsel takes notice on behalf of the 1st respondent and Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondents 2 & 3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

3.The grievance of the petitioner before this Court is that the representation dated 19.07.2025 made by the petitioners under Section 8(1) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, requesting for a fresh award in their names and reference of the Award No.C5/ 021/ 2022 dated 20.07.2023 to the appropriate Court for enhancement of compensation is not considered by the 2nd respondent so far.

4.Learned Additional Government Pleader appearing for the respondents

2 and 3 would submit that the Award No.C5/ 021/ 2022 dated 20.07.2023 will be referred to the appropriate Court within a period of two weeks.

5.Considering the submissions made by both the parties and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the 2nd respondent to refer Award No.C5/ 021/ 2022 dated 20.07.2023, to the appropriate Court for enhancement of compensation under Section 8(1) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, within a period of two weeks from the date of receipt of a copy of this order.

6.With the above direction, this writ petition is disposed of. There shall be no order as to costs.
