A memorandum of compromise submitted by both parties can lead to the disposal of a writ petition under Article 226.

ORDER

Writ petition is filed for a Writ of Certiorari, calling for the records in I.D.

No.59 of 2018 on the file of the Additional Labour Court, Coimbatore, and quash the award dated 16.03.2020.

2. The learned counsel for both the petitioner as well as respondent submitted that the matter has been settled and therefore, the writ petition may be disposed of recording the memorandum of compromise entered into between the parties.

3.The respondent is present in person before this Court and has acknowledged his acceptance of memorandum of compromise filed today. 4. The learned counsels submitted that in Clause 2(a) of memorandum of compromise, the date of joining of the respondent was given as 17.07.2025, since the memorandum of compromise was entered into on 15.07.2025. The learned counsels submitted that as the matter has been taken up only today, the date of joining may be replaced as 20.11.2025, instead of 17.07.2025, given in the memorandum of compromise.

5. In view of the submissions, the date of joining into service of the respondent is replaced with 20.11.2025, instead of 17.07.2025. So also, in Clause 2(c) of memorandum of compromise, the time for payment is shown as eight weeks, from the date of signing of the compromise, with consent of both the learned counsels, the same is modified to four weeks from today.

6.The memorandum of compromise dated 15.07.2025, is recorded, and the writ petition is disposed of in terms of the compromise entered into between the parties with the aforesaid modifications. The memorandum of compromise shall form part and parcel of the order.

Writ petition is accordingly dispose of. No costs. Consequently, connected miscellaneous petitions are closed.
