ORDER
By relying on sale deed dated 19.01.2009 (document No.122 of 2009)
and patta No.385 in the name of the petitioner's vendor, Jainab Beevi, the petitioner had applied for subdivision and separate patta. The present writ petition relates thereto.
2. Learned Additional Government Pleader accepts notice for respondents
1 to 3 and 5 and learned Government Advocate(crl. side) accepts notice for the 4th respondent. On the basis of written instructions, learned Additional Government Pleder submits that the petitioner's vendor also conveyed a portion of the land in S.No.130/2B1A1A to a third party, who appears to be in occupation of a portion thereof. Without prejudice, he states that the petitioner's request would be considered and disposed of on merits.
3. Considering the above submissions, without making any observations on the merits, this writ petition is disposed of by directing the second respondent to conduct an inquiry in relation to the petitioner's request for patta after issuing notice to the pattadhar, the petitioner and the rival claimant. Upon conclusion of such inquiry, a speaking order shall be issued within three months from the date of receipt of a copy of this order. No
