O R D E R
The present Transfer Civil Miscellaneous Petition has been filed with the following prayer:
“to withdraw the case pending on the file of the Family Court, Thoothukudi, in D.O.P.No.117 of 2023 and transfer the same to the District Family Court, Tirunelveli.”
2.The facts of the case, in a nutshell, led to filing of this Petition and necessary for disposal of same, are as follows:-
a)The Petitioner is the wife and the Respondent is the husband and their marriage was solemnized on 09.09.2022, according to Christian customs and rituals and out of their wedlock, they blessed with a baby boy, who is about two years old. Due to matrimonial dispute arose between them, the Petitioner had left the matrimonial home. The Respondent/Husband had filed the above case in D.O.P.No.117 of 2023, before the Family Court, Thoothukudi, against the Petitioner/Wife, for divorce on the ground of desertion and dereliction of duty as wife.
