The property in survey No.183/3 was classified in the UDR records as 'Ryotwari Punjai' and the name of the pattadar was recorded as Pallivasal under patta No.458. Patta No.458 reflects the name of the Pallivasal through its mutavalli. The Chitta and Adangal also contain similar entries. On the ground that the said property was erroneously reflected as 'Sarkar Poramboke' in the Town Survey Land Register and the utilization was shown as a vacant land, the petitioner had applied for rectification. The present Writ Petition has been filed seeking the early disposal of such request.
2. Learned Government Advocate accepts notice for respondents to
2 to 6 and learned Standing Counsel accepts notice for the first respondent. Learned standing counsel for the first respondent confirms that the property is recorded as Waqf property in the records of the Wakf Board. Learned Government advocate submits that the petitioner's request would be considered and disposed of within three (3) months.
3. The petitioner has placed on record revenue records relating to survey Nos.183/1A and 183/3. All these documents indicate the name of the pattadar as the Pallivasal through its mutavalli. The Town Survey Land register, however, records the land as 'Government Poramboke' and as a vacant site. In these circumstances, a case is made out to consider the petitioner's request expeditiously.
4. Accordingly, this Writ Petition is disposed of by directing the second respondent to consider the petitioner's request for rectification of the Town Survey Land Register and pass orders thereon within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and any other persons concerned.
No costs.
