The court established the procedure for conducting property surveys when legally justified ownership is claimed.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to deal with the representation made by the petitioner on 10.01.2025 and to conduct the survey in the subject property and demarcate the boundaries.

2. Heard Mr.M.D.Thirunavukkarasu, learned counsel for the petitioner and Mr.N.Naveen Kumar, learned Government Advocate for respondents 1 and 2.

3. The petitioner claims to be owner of the subject property by virtue of a registered Sale deed dated 31.07.2002 registered as document No.2277 of 2002. The further case of the petitioner is that the patta was also issued in the name of the petitioner in Patta No.3301. The petitioner wanted to conduct a survey in the subject property and hence, submitted various applications and the latest application on 10.01.2025 after paying the necessary charges. Since the same was not acted upon, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the respondents to act upon the application submitted by the petitioner on 10.01.2025 and to conduct the survey in the subject property based on the title documents and the patta that stands in the name of the petitioner and demarcate the boundaries. This process shall be completed within a period of four weeks from the date of receipt of a copy of this order. If there are any interested parties, such survey shall be conducted in their presence.

5. This writ petition is disposed of with the above directions.
