Natural justice requires opportunity for clarification before application rejection by authorities.

O R D E R

This writ petition has been filed challenging the online rejection order dated nd

23.08.2025 of the 2 respondent and for a consequential direction to the nd

2 respondent to issue patta in the name of the petitioner with respect to the subject property.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 and 2 and persued the materials available on record.

3. The petitioner claims right and title over the subject property by virtue of a registered Sale Deed dated 18.12.2019. The petitioner is also placing reliance upon the joint patta that has been issued in patta Nos.101 and 245. The petitioner applied for sub-division and for issuance of separate patta in her name. The nd grievance of the petitioner is that the 2 respondent through the online rejection order, informed the petitioner that the application has been rejected. Aggrieved by the same, the present writ petition has been filed before this Court.

In the considered view of this Court, if the 2 respondent was inclined to reject the application, the petitioner should have been given an opportunity and necessary clarification must have been received from the petitioner before passing orders. Since the same was not done, the online rejection order suffers from violation of principles of natural justice.

5. In view of the above, the online rejection order of the 2 respondent dated 23.08.2025, is set aside and the matter is remitted back to the file of the nd nd

2 respondent and the 2 respondent is directed to afford opportunity to all the interested parties and pass final orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

In the result, this writ petition is allowed with the above terms. No costs.
