O R D E R
This writ petition has been filed for a mandamus to the respondents to refix the salary of the petitioner and extend the other service benefits to him in view of the implementation of G.O.(Ms) No.19, Backward Classes / Most Backward Classes and Minorities Welfare Department, dated
07.03.2008, vide proceedings of the third respondent dated 05.01.2022.
2. Learned counsel for the petitioner submits that in similar circumstances, two other persons, who are also Cooks, were granted the very same relief that is sought for in this writ petition by the respondents. The said persons have also filed writ petitions in W.P.(MD) Nos.21219 & 21227 of 2022.
Therefore, learned counsel for the petitioner would submit that since the petitioner herein is a similarly placed person, the same relief will have to be granted to him also.
3. No prejudice will be caused to the respondents, if a direction is issued to them to consider the petitioner's representation seeking for the relief as sought for in this writ petition, in the light of the proceedings dated 04.11.2025 and 10.10.2025 issued in favour of the respective petitioners in W.P.(MD) Nos.21219 & 21227 of 2022 respectively.
4. This Court is not expressing any opinion on the merits of the petitioner's representation in the instant case and it is for the respondents to consider the same on merits and in accordance with law.
5. For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 31.05.2022, in the light of the proceedings dated 04.11.2025 and 10.10.2025 issued in favour of the respective petitioners in W.P.(MD) Nos.21219 & 21227 of 2022 respectively, who according to the petitioner, are identically placed persons, within a period of ten weeks from the date of receipt of a copy of this order.
No costs.
