IN THE HIGH COURT OF JUDICATURE AT MADRAS
ABDUL QUDDHOSE, J
A.M.Sundaravel – Appellant
Versus
The Principal Secretary, Public Works and Water Resource Organization Department – Respondent
W.P.(MD) No.23763 of 2022

Advocates:
For the Appellants/Petitioners: A.M.Sundaravel
For the Respondents: C.Satheesh, P.Gunasekaran

Failure to prosecute a petition can result in its dismissal if the petitioner shows disinterest.

Headnote:The judgment presents issues pertaining to a Writ Petition filed under Article 226 of the Constitution of India for quashing an impugned order and directing relevant payments. The court determined that the petitioner had shown disinterest in prosecuting the petition after several adjournments. The primary issue framed was the petitioner's lack of registration to appear as a party-in-person. Consequently, the court dismissed the petition for non-prosecution.

Result: 'This Writ Petition is dismissed for non-prosecution.'

O R D E R

The matter is listed under the caption “for dismissal” today.

At this stage, the learned Counsel on record for the petitioner submits that he has handed over the papers to the petitioner, who will be appearing as party-in-person. The petitioner [party-in-person] is also present. However, the petitioner [party-in-person] has not registered himself in the Registry as per the Rules to appear as party-in-person in this Writ Petition. This Writ Petition is of the year 2022. As seen from the earlier proceedings, several adjournments have already been granted to the petitioner to argue the matter. It can now be inferred that the petitioner is not interested in prosecuting this Writ Petition.

2.Accordingly, this Writ Petition is dismissed for non-

prosecution. There shall be no order as to costs.
