ORDER
This Criminal Revision Case has been filed challenging the order dated
06.10.2025 passed in Crl.M.P.No.870 of 2025 on the file of the Judicial Magistrate, Thirukoilur, thereby dismissing the petition filed for return of vehicle viz., JCB bearing Registration No. TN-15-H-3528.
2. The petitioner is the owner of the JCB bearing Registration No.TN-15-
H-3528, which was allegedly involved in the transportation of Vandal sand, without any valid license.
3. Based on the complaint, an FIR was registered in Crime No.383 of
2025 for the offences punishable under Sections 303(2), 132 of BNS r/w.section 21(1) of Mines and Minerals Act . Pursuant to the registration of the FIR, the said vehicle was seized and the same was produced before the Judicial Magistrate, Thirukoilur.
4. Heard the learned counsel appearing on either side and perused the materials available on record.
5. It is seen from the records that the petitioner is arrayed an accused in Crime No.383 of 2025. The petitioner filed a petition seeking return of the seized vehicle, which was dismissed by the Trial Court. Admittedly, the petitioner had transported Vandal sand for his personal use.
